Doctor’s Defamation Case Dismissed

The Superior Court of Guam recently dismissed a defamation lawsuit filed by Dr. George Macris.  The court cited the privilege between doctors to speak freely concerning management of life-threatening situations as the reason for dismissal.  Dr. Ian Richardson expressed concern about Dr. Macris’ assessment and management of a serious medical situation in a hospital memorandum.

Dr. Macris claimed this action was defamation while Dr. Richardson claimed his statements were true and not only protected, but encouraged, by physician privilege.  The court sided with Dr. Richardson and said doctors who speak up to their peers should be legally protected against defamation.
